The following terms and conditions form the conditions of hire and I would be grateful if you could ensure that you keep a copy to hand before the event and during your hire to avoid any disappointment or confusion on the day.  In particular I would draw your attention to the health and safety section and insurance sections. I trust you will find the terms laid out below neither onerous or impractical, but merely common sense, and helpful in ensuring your time at the Westgate is successful.

1    payment We will invoice you after your hire, or monthly for regular bookings. All cheques to be made payable to “The Westgate Chapel Trust (Lewes)”

2    operating hours Hire sessions are usually taken to mean: a.m.: 0900 – 1300, and p.m.: 1400 to 1800. Evening sessions are subject to negotiation and normally fall between the hours of 1900 – 2300.

3    health & safety The hirer has a responsibility to ensure that all members of their entourage behave in a reasonable manner at all times and take care to safeguard their own safety and that of other people present.

It is a condition of this contract that hirers and their representatives comply with the statutory local authority regulations regarding health, safety and fire precautions and any other safety measure deemed reasonably necessary by the staff of the Westgate.

All electrical equipment, both domestic and technical, brought into the Westgate by the hire company must have passed a portable appliance test (pat) in the last 12 months, and be fully insured.  Copies of supporting documentation should be provided to the Westgate administration on request.

All mechanical equipment brought into the Westgate by the hire company must be certified as being in safe working order by a qualified maintenance engineer, and must be fully insured.  Copies of supporting documentation should be provided to Westgate administration on request.

The Westgate is a no smoking building.  

4    insurance The Westgate and the hire company will each effect and maintain adequate insurance policies to cover all requisite statutory and other legal liabilities as follows:

The Westgate shall be responsible for public, third party and employer’s liability cover in respect of the venue, the staff of the venue and the general public visiting the venue.  

In any case not attributable to negligence on the part of the Westgate, the hire company shall be responsible for any claims in respect of the hire company’s employees and members of the public and for the property of the hire company and its employees arising out of the use and occupancy of the venue.  The hire company undertakes that the performances and other activities shall not be dangerous or harmful to the members of the hire company, employees of the Westgate or audiences and other participants, and shall be liable for and make good all loss or damage to Westgate property resulting from the negligence of the hire company.

The hire company and Westgate shall not do or allow to be done in or about the premises anything that would invalidate any insurance policy or which may cause any increased premium to become payable for such insurance, but shall at all times use all proper precautions to prevent loss, or damage or harm by fire or accident.

5    loss or damage to property The Westgate cannot be held responsible for loss or damage to property on the premises.  It is advised that valuables are kept secure and not left in the building overnight.

6    cancellation In the event of the hirer cancelling up to one month prior to the hire, the hirer agrees to pay 50% of the fee as a cancellation fee.  If less than one week prior to the hire then the full fee is payable.

7    equal opportunities  The Westgate is committed to the principles of diversity and equal opportunity for all and prohibits both unlawful and unfair discrimination throughout the organisation and its operations.  Our policy is to ensure that all persons are treated fairly irrespective of their colour, race, sex, sexual orientation, age or youth, religion, political beliefs, trade union membership or non-membership, marital, physical and mental status or any other factors, including pregnancy and maternity.   All companies and their representatives are expected to follow through this policy of making the building and its uses inviting to all visitors and users of the Westgate.
